2. Eligibility and accounts
You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Services. If a Service requires an account, you are responsible for keeping your credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.
3. Purchases, billing, and Merchants of Record
Paid features, subscriptions, and digital products are sold through third-party Merchants of Record who act as the seller of record:
- Apple (App Store) for iOS purchases;
- Google (Google Play) for Android purchases;
- Paddle for web/SaaS purchases.
Your purchase is also subject to the terms of the relevant Merchant of Record. Pricing, billing cycles, renewals, refunds, and cancellations are handled in accordance with those terms and the applicable store or checkout policies. Where consumer-protection law grants you withdrawal or refund rights, those rights are unaffected by these Terms.
4. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. You may not copy, modify, reverse engineer, resell, or create derivative works from the Services except as permitted by law.
5. Acceptable use
You agree not to use the Services to:
- break any applicable law or regulation;
- infringe the intellectual property, privacy, or other rights of others;
- distribute malware, or attempt to gain unauthorised access to systems or data;
- interfere with, disrupt, or place undue load on the Services;
- misrepresent your identity or impersonate others.
6. User content and the WWID platform
Some Services, in particular the WWID platform, let you create, publish, and link to content ("User Content"). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate and provide the Services.
You are solely responsible for your User Content and for ensuring you have the rights to publish it. You must not create, upload, publish, or link to content that:
- is adult, pornographic, or sexually explicit material, or that promotes or provides access to such material. This includes links or redirects pointing to adult or pornographic websites or content;
- is illegal or facilitates illegal activity, including child sexual abuse material (which is strictly prohibited and will be reported to authorities), content that infringes intellectual property, fraud, the sale of illegal goods or services, or the promotion of violence or terrorism;
- is hateful, harassing, or incites harm against individuals or groups;
- contains malware, phishing, or deceptive links; or
- otherwise violates these Terms, applicable law, or the policies of our distribution and payment partners.
This prohibition applies equally to content that is hosted on the platform and to outbound links and redirects from pages you create. We may remove User Content, disable links, suspend, or terminate accounts that violate these rules, with or without notice, and we may report unlawful content to the relevant authorities.
7. Intellectual property
The Services, including their software, design, trademarks, and content (excluding User Content), are owned by MAO Tech OÜ or its licensors and are protected by intellectual property laws. Product names and brands (such as WakeApp and WWID) are trademarks of their respective owners.
8. Third-party services and links
The Services may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.
10. Limitation of liability
To the maximum extent permitted by law, MAO Tech OÜ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Where liability cannot be excluded, it is limited to the amount you paid for the relevant Service in the 12 months preceding the claim. This clause does not limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
11. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or where required to protect the Services, other users, or our partners. Provisions that by their nature should survive termination will continue to apply.
12. Changes to the Services and Terms
We may modify the Services or these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, provide notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to conflict of law rules, and subject to any mandatory consumer-protection laws of your country of residence. Disputes are subject to the jurisdiction of the competent courts of Estonia, unless mandatory law provides otherwise.
